The feminicide crime and its judgment reflect a law and social recognition of fatal violence directed against the woman. Several countries in Latin America have incorporated into their legal systems the figure of femicide or femicide; however, despite the recognition of this criminal figure in Latin American legal systems, administrators of justice are still reluctant to apply it. This article presents a normative analysis regarding the Latin American countries that have modified their laws to include feminicide or femicide as a criminal and a case analysis to highlight the judge’s role toward the eradication of violence / death against women.
La tipificación del feminicidio y su juzgamiento reflejan el reconocimiento del Derecho y la sociedad de la violencia fatal dirigida contra el género femenino. Son varios los países en América Latina que han incorporado en su ordenamiento jurídico la figura de femicidio o feminicidio; sin embargo, pese a la tipificación de esta figura penal en los ordenamientos jurídicos latinoamericanos, los administradores de justicia aún son reacios a su aplicación. El presente artículo plantea un análisis normativo respecto de los países de América Latina que han modificado sus leyes para incluir el feminicidio o femicidio como tipo penal y un análisis jurisprudencial para destacar el rol que desempeñan las juezas y jueces en el combate a erradicar la violencia/muerte contra el género femenino a través de su jurisprudencia.
