La implementación del eje justicia y legislación del Plan Plurinacional para eliminar la discriminación racial y la exclusión étnica y cultural en Ecuador (2009-2017): factores determinantes

By Executive Decree No. 60, published in the Official Registry No. 45 of October 13th, 2009, the Ecuadorian government approved as public policy the Plurinational Plan with the objective of "eliminating racial discrimination and ethnic and cultural exclusion and promoting a plural, intercultural and inclusive citizenship" of historically discriminated peoples and nationalities (Coordinating Ministry of Natural and Cultural Heritage (MCPNC, as in Spanish), 2009: 27). One of the significant areas of this public policy focuses on the field: Justice and Legislation. In this context, this article analyzes the implementation phase of this axis of action an identifies those factors (institutional, political, economic, social and ideological) that have influenced how constraints in the implementation of actions and objectives initially raised, which generates a gap between rhetoric and practice.
Mediante Decreto Ejecutivo No. 60, publicado en Registro Oficial No. 45, de 13 de Octubre de 2009, el gobierno ecuatoriano aprobó como política pública el Plan Plurinacional con el objetivo de “eliminar la discriminación racial y la exclusión étnica y cultural y promover una ciudadanía plural, intercultural e inclusiva” de los pueblos y nacionalidades históricamente discriminados (Ministerio Coordinador de Patrimonio Natural y Cultural (MCPNC), 2009: 27). Uno de los ejes sustanciales de esta política pública se enfoca en el ámbito: Justicia y Legislación. En este contexto, el presente artículo analiza la fase de implementación de este eje de acción e identifica aquellos factores (institucionales, políticos, económicos, sociales e ideológicos) que han incidido como limitantes en la ejecución de las acciones y objetivos inicialmente planteados, lo cual, genera una brecha entre la retórica y la praxis.
