Description: This article summarizes the legislative process of creating the criminal type of psychological violence against women or members of the family nucleus. It responds to the need to show how the straitjacket of wording of Law can be limiting the effective-ness of the Justice system in relation to the criminal type of psychological violence against women within the couple relationship and the rights and guarantees of victims. At the same time, it shows the factors of the praxis of Law that were taken into account for the description of this crime ant the problems that are generating impunity.
Este artículo sintetiza el proceso legislativo de creación del tipo penal de violencia psicológica contra la mujer o miembros del núcleo familiar. Responde a la necesidad de evidenciar de qué manera la camisa de fuerza del derecho positivado puede estar limitando la eficacia del sistema de justicia penal y los derechos y garantías de las víctimas. Al mismo tiempo, muestra los factores de la praxis del derecho que fueron tomados en cuenta para la descripción de este delito y los problemas que están generando impunidad y limitando el acceso a la justicia de la mujer violentada.
