La afectación al derecho humano de propiedad privada ocasionado por los procesos de liquidación forzosa de las cooperativas de ahorro y crédito en el Ecuador

El trabajo contiene un análisis sobre la afectación al Derecho Humano de Propiedad Privada, reconocido en la Constitución del Ecuador y en los instrumentos internacionales, el cual se menciona en la Declaración Universal de Derechos Humanos (1948), en el artículo 17 numerales 1-2 lo siguiente: “Toda persona tiene derecho a la propiedad, individual y colectivamente y nadie será privado arbitrariamente de su propiedad”. Además es natural e imprescriptible y permite gozar, satisfacer, destinar e inclinarse al bien individual y común, en función de las limitaciones de ley, que para el presente estudio, la propiedad privada afectada se refiere al dinero depositado en las cooperativas de ahorro y crédito (COAC); el problema radica en que muchas personas fueron afectadas por los procesos de liquidación forzosa realizados a varias de éstas entidades, lo cual ocasionó a muchos depositantes, acreedores, socios y cuenta ahorristas, el bloqueo de sus fondos, que en muchos casos nunca podrán ser recuperados.
The work contains an analysis on the affectation to the Human Right of Private Property, recognized in the Constitution of Ecuador and in the international instruments, which is mentioned in the Universal Declaration of Human Rights, in article 17, numerals 1-2 as follows: "All person has the right to property, individually and collectively and no one shall be arbitrarily deprived of their property". Also is natural and imprescriptible and allows to enjoy, satisfy, allocate and lean to the individual and common good, depending on the limitations of law, that for the present study, the private property affected refers to the money deposited in the savings and credit cooperatives (COAC); the problem is that many people were affected by the forced liquidation processes carried out to several of these entities, which caused many depositors, creditors, partners and account holders to block their funds, which in many cases could never be recovered.
