NATURAL PENALTY AS A CRITERION OF OPPORTUNITY: A BRAKE ON CRIMINAL EXPANSIONISM

Latin American legislations are recognized for their propensity towards inflation or expansion of criminal law. As refers (Maier, J. Córdoba, G. 2009) if that criminal expansion has no limits, correlatively to the expansion of the state penalty; the only thing that will be achieved is a police state or gendarme. Fortunately, against this expansionist politics, there are institutions that promote a more humanitarian criminal law, one of them is the natural punishment. Therefore, this article will clarify that the legal tool that the fiscal ministry has to rationalize the punitive power of the State is found in the institution of natural punishment, through the principle of opportunity; making this way effective the postulates of minimum intervention and proscription of cruel punishments, by dispensing the criminal action or desisting from the one initiated when a case of its application is presented.
Las legislaciones latinoamericanas son reconocidas por propender hacia la inflación o expansión del derecho penal. Conforme señala (Maier, J. Córdoba,G. 2009) si esa expansión penal carece de límites, correlativamente a la de la expansión de la pena estatal; lo único que se logrará es un Estado policial o gendarme. Afortunamente frente a esta política expansionista, existen instituciones que propugnan un derecho penal más humanitario, una de ellas es la pena natural. Por lo tanto, este artículo dilucidará que la herramienta jurídica que posee el ministerio fiscal para racionalizar el poder punitivo del Estado se encuentra en la institución de la pena natural como criterio de oportunidad reglado; haciendo efectivos los postulados del intervencionismo penal mínimo y proscripción de penas crueles, al prescindir de la acción penal o desistir de la iniciada cuando se presente un hipotético de su aplicación.
