Las audiencias telemáticas y la afección al principio de inmediación en Ecuador

En la presente investigación, se realizó un estudio sobre el quebrantamiento del principio de inmediación por la ausencia física de los testigos y peritos en las audiencias telemáticas. En este proyecto investigativo se dio un enfoque cualitativo, con alcance descriptivo en función de entender de manera más directa los principales conceptos jurídicos del principio de inmediación en las diferentes instituciones jurídicas, los métodos utilizados fueron dogmático, inductivo-deductivo y analítico, las técnicas que se utilizaron fueron el fichaje y la base de datos científicas. En lo correspondiente a los resultados se determinó que las audiencias telemáticas llevadas desde el inicio de la pandemia del covid 19, si lesionó al principio de inmediación, porque limitó la labor del juez en dirigir el entorno judicial y realizar un juicio de valor sobre la prueba testimonial. Por lo tanto, afectó los derechos de las partes al dictarse sentencias no apegadas a la ley.
In this research, a study on the breach of the principie of immediacy dueto the physical absence of witnesses and experts in telematics hearings was carried out. In this research project a qualitative approach was applied, with a descriptive scope in arder to understand the main legal concepts of the principie of immediacy in different legal entities more directly, the methods used were dogmatic, inductive-deductive and analytical, the techniques applied were the file and scientific data base. Regarding the results, it has been determined that the telematics hearings carried out since the beginning of the Covid 19 pandemic damaged the principie of immediacy, since they limited the judge's labor in directing the judicial environment and making a value judgment on the witness evidence. Therefore, it affected the constitutional rights of the parties by issuing sentences that were not in accordance with the law.
