La maternidad por sustitución es un procedimiento que inicia con un contrato o convenio entre las partes intervinientes, que puede ser altruista u oneroso, con la finalidad de poder acceder a la procreación a través de las técnicas de reproducción humana asistida, gracias a los avances médicos y tecnológicos, a favor de la mujer, que cuya capacidad biológica no le permite la concepción o de darse el embarazo no puede llegar al parto, por problemas de infertilidad o esterilidad; y en efecto, no poder fundar una familia, por tal razón, este tipo de procedimiento, garantiza los derechos de reproducción y la salud reproductiva de las parejas, quienes tienen la libertad y la autonomía de elegir qué técnica utilizar de acuerdo a sus necesidades, además, de disfrutar y ejercer este derecho de reproducción con igualdad reproductiva y no discriminada, tanto la pareja como el niño nacido en esta modalidad.
Surrogate motherhood is a procedure that begins with a contract or agreement between the parties involved, which can be altruistic or onerous, aiming at being able to access procreation through assisted human reproduction techniques, thanks to medical and technological advances, in favor of the woman, whose biological capacity does not allow her to conceive, or in the event of becoming pregnant she cannot give birth due to infertility or sterility problems, and indeed, not being able to found a family. For this reason, this type of procedure guarantees the reproductive rights and health of the couples, who have the freedom and autonomy to choose which technique to use according to their needs, as well as to enjoy and exercise this right of reproduction with reproductive equality and without discrimination, both the couple and the child born in this modality.
