El mundo atravesó una serie de cambios provocados por la pandemia por COVID-19 en el año 2020, que como consecuencia trajo consigo que las personas nos aislemos y que no tengamos ningún contacto social para evitar la propagación del virus y que no existan contagios masivos. El sistema judicial también paso por grandes cambios a consecuencia de esta pandemia, cambio que se vio reflejado con la implementación de las audiencias telemáticas, que fue implementado mediante protocolo por la Corte Nacional de Justicia. Las audiencias telemáticas están relacionadas con el principio de inmediación dentro de un proceso oral por audiencias, que no es otra cosa más que el contacto directo que tiene el juez con las partes procesales, con la práctica de prueba, para que mediante el cumplimiento de cada precepto pueda el juzgador tomar la mejor decisión. Para poder analizar el efecto o relación del principio de inmediación en la práctica de prueba, empezaremos analizando cada uno de los componentes de manera individual para poder llegar a un mejor entendimiento del tema. Por lo que la presente investigación será de tipo cualitativa, debido a que, a través de su conceptualización, y fundamentos epistemológicos, lograremos tener una información más detallada sobre este principio de inmediación con la práctica de prueba en las audiencias telemáticas.
The world went through a series of changes caused by the COVID-19 pandemic in 2020, which as a result brought people to isolate ourselves and that we do not have any social contact to avoid the spread of the virus and that there are no massive infections. The judicial system also went through major changes as a result of this pandemic, change that was reflected with the implementation of telematic hearings, which was implemented by protocol by the National Court of Justice. The telematic hearings are related to the principle of immediacy within an oral process for hearings, which is nothing more than the direct contact that the judge has with the parties to the proceedings, with the practice of evidence, so that through the fulfillment of each precept the judge can make the best decision. In order to be able to analyse the effect or relationship of the principle of immediacy in the taking of evidence, we will start by analyzing each of the components individually in order to reach a better understanding of the subject. Therefore, the present investigation will be qualitative, since, through its conceptualization, and epistemological foundations, we will be able to have more detailed information on this principle of immediacy with the taking of evidence in telematic hearings.
