Dentro del presente trabajo se realizó un estudio el cual tiene por finalidad demostrar que una persona jurídica no tiene la capacidad de cometer delitos, para lo cual se desentraño doctrina desde la concepción clásica y finalista, empezando con conceptos fundamentales de teoría del delito sobre la conducta penalmente relevante y las personas jurídicas, para luego estudiar los tres elementos del delito como la tipicidad, antijuridicidad y culpabilidad frente a dicha atribución y su repercusión en nuestra legislación penal, por lo que se obtuvo como resultado que la dogmática de la Teoría del Delito y la atribución de responsabilidad penal a las personas jurídicas es inconsistente por cuanto se contradice en repetitivas ocasiones, debido aquello se puede determinar y concluir que una persona jurídica no es capaz de imputación jurídico penal con las teorías vigentes y menos aún con el Código Orgánico Integral Penal, que es mucho más técnico
The purpose of this document is to carry out a doctrinal literature review about the criminal responsibility of legal persons. The literary review begins with an analysis of the origin of the legal entity as a subject of law, the ideas and doctrines that are in favor and against his personification and the duties and responsibilities that they acquire. Subsequently, the regulations in force in the country were analyzed through two legal bodies such as the 2008 Constitution, the Organic Integral Criminal Code; to identify the structure of the crime, and what are the penalties that can be imposed on legal persons. Finally, in the third part, an analysis of the liability and guilt of legal persons within the national scope, the limits of criminal culpability; In addition to the sanctions that are taxable on legal persons and the principles that limit the criminal actions of the State.
