La presente investigación partió de la premisa que Ecuador como Estado constitucional de derechos y justicia, reconoce a sus habitantes el cumplimiento de las diversas garantías consagradas en la Constitución. Durante el desarrollo de esta investigación se identificaron diversas obligaciones del Estado frente al derecho de acceso a medicamentos y tratamientos de calidad enfocándose en personas que adolecen enfermedades catastróficas. Todo lo anterior arrojó como resultado que la vulneración de este derecho es producida por entidades de salud del sector público. El enfoque de la investigación es mixto, es decir, se utilizaron los métodos cualitativo y cuantitativo, que va desde el método dogmático jurídico con técnicas de recolección de información, así como la revisión bibliográfica y bases de datos científicas, respaldadas en análisis de casos y sentencias. Asimismo, se utilizó técnicas de investigación tales como: la construcción de cuestionarios, tablas y gráficos para la interpretación y discusión de los resultados, de los cuales se desprende, la existencia de vulneración de este derecho.
This research was based on the premise that Ecuador, as a constitutional state of rights and justice, has to recognize and comply with the guarantees enshrined in the Constitution with its citizens. During the development of this research, several obligations of the State were identified regarding the right of access to medicines and quality treatment, focusing on people suffering from catastrophic diseases. The result of all the above was that health entities of the public sector violated this right. The research approach was mixed; qualitative and quantitative methods were used, ranging from the dogmatic legal method with information-gathering techniques to bibliographic review and scientific databases, supported by analysis of cases and sentences. Likewise, research techniques such as the elaboration of questionnaires, charts, and graphs were used to interpret and discuss the results, from which the existence of a violation of this right can be deduced.
