El presente trabajo lleva como título: Análisis de la consulta realizada a la procuraduría general del estado, en relación a la prohibición de inscripción en el registro civil de las actas de mediación de reconocimiento voluntario de paternidad, publicada en el registro oficial 143, 4-III-2010; en relación que la Procuraduría General del Estado ante pregunta realizada por el Registro Civil en relación a las actas de mediación sobre paternidad ha emitido el siguiente dictamen de acuerdo al Art. 2352 del CC en el que se tipifica que: “no se puede transigir sobre el estado civil de las personas” (Código Civil, 2016). Lo que involucra aquellas actas efectuadas en los centros de mediación en los que se reconozca paternidad, no son suficientes para establecer el estado civil de una persona, lo que conlleva un nuevo proceso para la paternidad en la parte judicial, originándose un problema con el principio de cosa juzgada sobre las actas de mediación, así cómo también se vulneran varios principios como el interés superior de los menores, el derecho constitucional de identidad. Razón por la cual se ha utilizado varios métodos investigativos como el cualitativo, inductivo, deductivo, analítico que faciliten el desarrollo del trabajo y se logre identificar si esta prohibición realizada al Registro Civil de inscripción de las actas de mediación de paternidad es válida o se están vulnerando derechos de los menores. Durante el trabajo se analiza el criterio de abogados en libre ejercicio, como de jueces y personal del Registro Civil todo con la finalidad de identificar la pertinencia de la prohibición y si se debería realizar reformas que faciliten el reconocimiento de paternidad en el Registro Civil a través de estas actas.
This paper is entitled: Analysis of the consultation made to the State Attorney General's Office concerning the prohibition of registration in the Registry Office of the mediation acts of voluntary recognition of paternity, published in the official register 143, March 4, 2010; with regard to the fact that the State Attorney General's Office, in response to a question made by the Registry Office about the mediation acts on paternity, has issued the following opinion in line with Article 2352 of the Civil Code, which states that: "it is not possible to compromise on the civil status of persons" (Civil Code, 2016). What involves those acts carried out in the mediation centers in which paternity is recognized, are not sufficient to establish the marital status of a person, which leads to a new process for paternity in the judicial part, originating a problem with the principle of res judicata on the acts of mediation, as well as several principles are violated as the best interest of minors, the constitutional right of identity. The reason why several investigative methods have been used as the qualitative, inductive, deductive, analytical that, facilitate the development of the work and it is possible to identify if this prohibition made to the Registry Office of the inscription of the acts of mediation of paternity is valid or is being violated rights of the minors. During the work, the criteria of lawyers in free exercise, as well as judges and personnel of the Registry Office are analyzed, all to identify the relevance of the prohibition and if reforms should be made to facilitate the recognition of paternity in the Registry Office through these records.
