El lavado de activos es un mecanismo a través del cual se oculta el verdadero origen de dinero o bienes provenientes de actividades ilícitas. La presente investigación determina que la falta de implementación de un control interno y el no reporte a la Unidad de Análisis Financiero y Económico (UAFE) de las transacciones realizadas por las fundaciones no adscritas a la Secretaría Técnica de Cooperación Internacional (SETEI), que vulnera el principio de igualdad formal, material, seguridad jurídica entre otras. En este sentido la investigación posee un enfoque cualitativo, que a través del uso de los métodos dogmático, analítico sintético, inductivo deductivo, analiza la resolución, con la finalidad de prevenir el lavado de activos en fundaciones no adscritas a este organismo.
Money laundering is a mechanism through which the true origin of money or goods from illicit activities is hidden. The present investigation determines that the lack of implementation of an internal control and the failure to report to the Financial and Economic Analysis Unit (UAFE) of the transactions carried out by the foundations not attached to the Technical Secretariat of International Cooperation (SETECI), wich violates the principle of formal equality, material, legal security among other. In this sense, the research has a qualitative approach, which through the use of dogmatic methods, synthetic analytical, inductive deductive, analyzes the resolution of the UAFE and doctrine about money laundering, since there is an anomy that allows these foundations to escape of control. Consequently, a reform to this resolution is proposed, with the purpose of preventing the laundering of assets in foundations not attached to this body.
