Description: El presente trabajo tiene como finalidad indicar las problematicas que existe en la normativa correspondiente a prescripción de la potestad sancionadora y caducidad en el procedmiento administrativo sancionador en materia de Hidrocarburos, ya que subyace una serie de conflictos normativos que deben ser resueltos. Esto crea una inseguridad jurídica que debe ser abordada en nuestra legislación ya que los administrados deben tener certeza sobre las posibles acciones de defensa en el caso de una posible sanción.
The purpose of this work is to indicate the problems that exist in the regulations corresponding to the prescription of the sanctioning power and expiration in the administrative procedure sanctioning in the matter of Hydrocarbons, since it underlies a series of regulatory conflicts that must be resolved. This creates legal uncertainty that must be addressed in our legislation as the administrators must be certain about possible defense actions in the event of a possible penalty.
