El proceso de contratación pública en el exterior permite que las entidades contratantes a través del literal d, del Art. 125 del Código Orgánico de la Producción, Comercio e Inversiones, COPCI, estén exentas del pago de todos los tributos al comercio exterior en las importaciones realizadas por entidades del Sector Público. Por este motivo, muchas instituciones, para ahorrar los costos de adquisición al no existir intermediarios, dar posibilidad de elección de sistemas y equipos de última tecnología, entregar garantía directa del fabricante, facilidades para obtener alta disponibilidad de partes y piezas del sistema para reemplazo en caso de daños, y al no tener normativa que regule la selección del proveedor del exterior es imperativo regular y dictaminar parámetros mínimos para la selección de proveedores extranjeros, y así evitar que esta forma de contratar sea un medio para eludir las reglamentaciones del sistema nacional de compras públicas.
The process of public procurement abroad allows contracting entities, through literal d, Art. 125 of the Organic Code of Production, Trade and Investment, COPCI; to be exempt from the payment of all taxes on foreign trade in imports made by entities of the Public Sector. For this reason, many institutions, with the aim of saving acquisition costs as there are no intermediaries, give the possibility of choosing the latest technology systems and equipment, provide direct manufacturer's guarantee, facilities to obtain high availabilit y of parts and components of the system for replacement in case of damages.By not having regulations governing the selection of the foreign supplier, it is imperative to regulate and dictate minimum parameters for the selection of foreign suppliers, and thus avoid that this form of contracting is a means to circumvent the regulations of the national system of public purchases.
