El Arbitraje ha ido evolucionando como uno de los métodos hetero-compositivos de resolución de conflictos más utilizados, tanto a nivel nacional como a nivel mundial. Si bien es cierto, existe un adagio dentro de la teoría general del negocio jurídico el cual nos menciona que el contrato es considerado ley única y exclusivamente para las partes suscriptoras. Es decir, no beneficia ni perjudica a terceros no signatarios. Tanto la diversidad de vínculos que nacen de los contratos y las nuevas teorías que nos proporciona la doctrina en conjunto con ciertos fallos arbitrales a nivel internacional, nos hace llegar a la conclusión de que existe la posibilidad de que un acuerdo arbitral se extienda para una parte no signataria del mismo. Tema el cual es objeto de mi presente investigación toda vez que constituye un problema de falta de regulación dentro de nuestro ordenamiento jurídico.
Arbitration has evolved as one of the most widely used hetero-compositional conflict resolution methods, both nationally and globally. Although it is true, there is an adage within the general theory of legal business which mentions that the contract is considered law solely and exclusively for the subscribing parties. That is, it does not benefit or affect injuriously third parties that are not signatories. Both the diversity of connections that arise from contracts and the new theories that the doctrine provides us in conjunction with certain arbitration rulings at the international level, makes us conclude that there is the possibility that an arbitration agreement is extended for a party not a signatory thereof. Subject which is the object of my present investigation since it constitutes a problem of lack of regulation within our legal system.
