El Derecho de Eliminación en el SATJE busca otorgar la posibilidad de que los titulares de los Derechos personales puedan decidir acerca del uso de su información privada, fundamentado en el derecho a la libre autodeterminación informativa almacenada en las distintas entidades estatales o incluso privadas; el Derecho de Eliminación está orientado a que, el tratamiento de los datos de índole personal no sean perjudiciales como producto de la estigmatización que le pueda llegar a dar la ciudadanía o un tercero, extraño a esta información, por lo que se intenta o se busca que en las causas que haya operado sobreseimiento, el procesado pueda acudir al órgano administrativo para que así su nombre no sea relacionado a una infracción por la cual él no tiene ningún tipo de responsabilidad. Lo que se lograría con esta eliminación es garantizar correcto uso de la información privada y el respeto a los derechos fundamentales reconocidos en la constitución y en la nueva Ley Orgánica de Protección de Datos Personales.
The elimination right in the SATJE searches to let holders of personal rights decide about the different uses of their very own private information, which is often stored in various public, and sometimes even private, institutions. This is substantiated in the right of free self-informative determination. The elimination right orbits around the handling of personal information, avoiding the mishandle or misuse by third parties who might likely suffer from misinformation regarding a specific topic. It is intended that in trials that ended in dismissals, the accused is able to, after a proper visit to the corresponding administration, have his name cleaned and disconnected from the website of the SATJE about the charges that were previously dismissed by a judge. To guarantee the correct and proper use of private information, along with the respect for fundamental rights stated in the constitution and the new Organic Law of Personal Data, is the goal to be achieved.
