Indistintamente de la finalidad que cada sociedad haya elegido, de su poder punitivo nace la interrogante de si existen factores y condiciones indispensables para que dicho fin se cumpla; y, de ser éste el caso, es necesario entender que, sin dichas condiciones, no se puede pretender lograr el cumplimiento del fin de la pena en escenarios diversos. Dicho esto, se advierte que el sistema de ejecución de penas se encuentra frente al desafío de lograr armonía, pertinencia y, por ende, eficacia, mediante el reconocimiento y aplicación de dichos factores, una vez que el sistema clarifique sus intenciones y fines. La determinación del fin de la pena supone no solo una discusión interminable, sino también un paso previo a la búsqueda de condiciones más acertadas en torno a la ejecución del castigo, por lo que es necesario establecer cuál es la postura de una sociedad, a fin de lograr las correctas condiciones de cumplimiento en virtud de dicho fin, resaltando las expectativas mínimas.
Regardless of the purpose that each society has chosen, from its punitive power arises the question of whether there are factors and conditions imperative for that goal to be fulfilled; and, if this is the case, it is necessary to understand that, without these conditions, it is not possible to achieve compliance with the goal of the penalty in other scenarios. Having said that, it is noted that the system of execution of penalties faces the challenge of achieving harmony, relevance and, therefore, effectiveness, through the recognition and application of these factors, once the system clarifies its intentions and purposes. Determining the purpose of punishment is not only an endless discussion, but also a step before the search for better conditions around the execution of punishment, so it is necessary to establish what a society's position is, in order to achieve the correct conditions of fulfilment under that end, highlighting the minimum expectations.
