Los seres humanos llevamos inherentes a nuestra naturaleza una serie de derechos fundamentales. Siendo individuos sociales, hemos adoptado una forma de vida en sociedad que provoca que estemos en convivencia con otros individuos quienes, con pocas excepciones, gozan de los mismos derechos que nosotros. En consecuencia, en el normal desarrollo de nuestras vidas y mientras estamos ejerciendo nuestros derechos, existen momentos en los que ocurre una colisión entre estos. Sin embargo, nuestra constitución garantista concibe a todos los derechos como de igual jerarquía. Esto quiere decir que, al menos en teoría, ningún derecho debería primar sobre algún otro. Entonces, se crea la necesidad de determinar cuál debiere ser la forma en la que quien imparta justicia, actúe frente a un caso así. Especialmente cuando son dos derechos que colindan por su propia esencia como es el caso del derecho a la libertad de expresión y el derecho a la honra y el buen nombre.
Human beings carry inherent in our nature a series of fundamental rights. Being social individuals, we have adopted a way of life in society that causes us to be in constant coexistence with other individuals who, with few exceptions, enjoy the same rights as us. Consequently, in the normal course of our lives and while we are exercising our rights, there are times when the collision occurs. However, our guarantor constitution conceives all rights as of equal rank. This means that, in theory at least, no right should take precedence over any other. Then, the need is created to determine what should be the way in which whoever administers justice acts in such a case. Especially when they are two rights that are adjacent by their very essence, such as the right to freedom of speech and the right to honor and good name.
