Análisis del error judicial y la responsabilidad del estado en cuanto a su resarcimiento en la legislación ecuatoriana.

Description: El motivo del presente trabajo de investigación consiste en analizar la aplicación del Error Judicial como figura jurídica dentro de los marcos normativos de la legislación ecuatoriana en cuanto a que dicha institución jurídica tiene la finalidad de proteger derechos constitucionales dentro del proceso judicial que pueden ser vulnerados por agentes relativos al estado pertenecientes al sistema judicial. Con el presente trabajo se pretende dar conocer más sobre esta importante figura jurídica con el fin de poder crear consciencia entre los aplicadores de justicia y los ciudadanos usuarios del sistema judicial para que de alguna forma se respeten más los derechos constitucionales que giran en torno a esta como los derechos del debido proceso, tutela judicial efectiva y seguridad jurídica.
The reason for the error is the application of judicial error as a legal figure within the regulatory frameworks of Ecuadorian legislation in that the legal institution has a constitutionally protected legal purpose within the judicial process that can be violated by agents related to the state belonging to the judicial system. With the present work is to learn more about this important legal figure in order to create awareness among users of justice and users of the judicial system to know what form is respected more constitutional rights that revolve around this as the rights of due process, effective judicial protection and legal security.
