La cooperación eficaz en el Ecuador, un breve análisis de su aplicabilidad procesal.

Con la coope ración eficaz el procesado pretende la obtención de beneficios atenuantes en su pena, por ello realiza un acuerdo con la Fiscalía General del Estado. El Convenio consiste en que el procesado provee información verídica, comprobable, precisa y oportuna que permita esclarecer los hechos investigados o vincular a los demás responsables. Este acuerdo se realiza de manera escrita para que exista constancia de lo pactado. Para la Fiscalía General del Estado la cooperación eficaz es una herramienta útil. El coope rador al aportar la información por el acuerdo está sujeto a un beneficio que es la reducción de la pena en un mínimo del 20% y en caso de gran conmoción social hasta un mínimo del 10%. El hecho de lograr identificar al cooperador es una vía por la cual se podría desmantelar una organización criminal, ya que al colaborar con la justicia confes ando sus acciones y revelando datos sobre los demás implicados en el delito coadyuva a conocer los diferentes niveles de la estructura criminal.
With the Plea Agreement the Defendant intends to get a lesser charge or a more lenient, sentence. This is an agreement between the defendant and the General Prosecutor. The defendant must provide opportune, truthful, precise, demonstrable information that will lead to clear up the crimes that are been investigated or find out about other people that are involved The Plea Agreement is a formal written agreement and is a useful tool for the Prosecutor. If the defendant collaborates with the i nformation under the terms of the agreement the sentence can be reduce minimum 20% and 10% in a very publicized case. The defendant can be the link to dismantle the criminal organization by confessing the crimes and giving information about the other people that might be involved in such activities it will help to lead to disclose the different levels of the criminal structure.
