El tercero extraño al litigio y su posible legitimación en procesos de conocimiento.

Desde siempre ha existido la interrogante de quiénes y bajo qué condiciones pueden y deben intervenir en el proceso y cuya respuesta preliminar ha sido la de todas aquellas personas a quienes la decisión afecte directamente, pues dentro del mismo no se debe admitir participación de extraños o terceros a la cuestión litigiosa puesto que un asunto debe debatirse únicamente en presencia de las personas a quienes vinculará la decisión; sin embargo, existen ocasiones en que una decisión si bien no despliega sus efectos hacia terceros, tal decisión puede repercutir sobre una relación sustancial que tenga un tercero con cualquiera de los litigantes. En razón de este evento es que surge la necesidad de estudiar la participación de terceros ajenos a la cuestión litigiosa, quienes tratan de ingresar al proceso en aras de precautelar un asunto propio que, si bien no se encuentra en debate, puede ser afectado indirectamente por la decisión judicial. Por este motivo debemos examinar si es que admitida la participación de un tercero su actuación debería o no ser limitada, lo cual nos ayudará a contestar el siguiente gran cuestionamiento ¿En qué medida el tercero ajeno a la cuestión litigiosa puede resultar afectado por la decisión judicial de tal forma que se justifique su admisión al proceso por el solo hecho de argumentar y justificar una eventual afectación?.
There has always been the question of who and under what condition they can and should intervene in the process and whose preliminary response has been that of all those people directly affected by the decision, since the participation of strangers or third parties should not be allowed within it to the litigious issue since a matter should be discussed only in the presence of the persons to whom the decision will be linked; however, there are occasions when a decision, although it does not display its effects towards third parties, may result in a substantial relationship between a third party and any of the litigants. Because of this event is that there is a need to study the participation of third parties outside the litigious issue, who try to enter the process in order to safeguard their own issue that, although not in debate, can be indirectly affected by the judicial decision. For this reason we must examine whether it is admitted that the participation of a third party action should or should not be limited, which will help us answer the next big question to what extent the third party outside the litigious issue may be affected by the court decision in such a way that its admission to the process is justified by the mere fact of arguing and justifying an eventual affectation?.
