En el siguiente trabajo investigativo se hará una breve introducción sobre los contextos históricos del pueblo indígena, la opresión y discriminación que estos pueblos han sufrido a lo largo de la historia. En los últimos años sus derechos han sido reconocidos por leyes y convenios internacionales y por la Constitución de la República. Teniendo este pequeño preámbulo, en el capítulo I se dará una prospectiva general sobre el procedimiento, aplicación y las distintas sanciones que se imponen dentro de la justicia indígena el cual se basa en el derecho consuetudinario, tradiciones ancestrales, y el significado que estas sanciones guardan dentro de la cosmovisión ancestral. Por último, en el capítulo II se hará un análisis sobre la sentencia N. 113-14-SEP-CC ¨La Cocha II¨ y se responderá a la pregunta planteada ¿es la sentencia una limitante para la justicia indígena?
In the following work, a brief introduction will be made about the historical contexts of the indigenous people, the oppression and discrimination that these people have suffered throughout history and that in recent years their rights have been recognized by laws and international agreements and by the Constitution of the Republic. Having this small preamble, in chapter I. I will give a general perspective about the procedure, application and the different sanctions that are imposed within indigenous justice. Always following their ancestral traditions and based on the customary law, and the meaning that these sanctions keep within the ancestral worldview. Finally, in chapter II an analysis will be made about sentence N. 113-14-SEP-CC ¨La Cocha II¨ and the question asked will be answered, is the sentence a limitation for indigenous justice?
