Description

El Ministerio de Trabajo, con fecha 24 de diciembre de 2020 emitió el Acuerdo Ministerial número MDT-2020-286, mediante el cual se resolvió el régimen especial de trabajo para el personal docente de las instituciones de educación superior. Este acuerdo genera una restricción al derecho a la estabilidad laboral que tienen estos trabajadores y lo podemos corroborar de tal manera que el Estado garantiza esta aplicación directa de las normas constitucionales e instrumentos internacionales de derechos humanos siempre que sean lo más favorable, incluso sin que sean invocadas por los justiciables. Este derecho que es tan importante puesto que no puede alegarse la existencia de una norma que con el criterio de que rige este régimen especial de trabajo, menoscaba los derechos humanos, teniendo en cuenta que refiere al derecho al trabajo, el cual está garantizado con todos sus beneficios sociales por la ley y la Constitución de la República.
The Ministry of Labor, on December 24, 2020, issued the Ministerial Agreement number MDT-2020-286, through which the special work regime for teaching staff of higher education institutions was resolved. This agreement generates a restriction on the right to job stability that these workers have and we can corroborate it in such a way that the State guarantees this direct application of constitutional norms and international human rights instruments whenever they are the most favorable, even without being invoked by the defendants. This right, which is so important, since the existence of a norm cannot be alleged that, with the criteria that this special labor regime governs, undermines human rights, taking into account that it refers to the right to work, which is guaranteed with all their social benefits by law and the Constitution of the Republic.
