El presente trabajo académico tiene por objeto el análisis y estudio del Derecho a la resistencia, conocido a su vez como desobediencia civil en la esfera constitucionalista, además pretenderá hacer un recorrido histórico, ocupando ejes trasversales de la materia. El Derecho a la Resistencia se encuentra consagrado en la Constitución de la República del Ecuador, del mismo texto conocemos la imposibilidad de limitar el derecho, en este caso, el de resistirse acciones de la sociedad sin justificativo y sustento jurídico. Sin embargo, podemos efectivamente incorporar elementos para el adecuado alcance y el no entorpecimiento de otros derechos con mayor importancia e ulterior ponderación; bajo la luz del contrato social, el principio de gobernabilidad y la Bona Fide, necesariamente debe existir un equilibrio, por ello, es importante delimitar el contenido del mismo con la finalidad de que su funcionabilidad se realice dentro de un marco idóneo en donde el Derecho a la Resistencia, no vulnere demás derechos consagrados en nuestro ordenamiento jurídico.
The purpose of this academic work is the analysis and study of the Right to Resistance, known in turn as civil disobedience in the constitutionalist sphere, and will also try to make a historical journey, occupying transversal axes of the subject. The Right to Resistance is enshrined in the Constitution of the Republic of Ecuador, we know the impossibility of limiting a right, in this case, that of resisting a certain society under the conceptualization described. However, we can effectively incorporate elements for the adequate scope and non-obstruction of other rights with greater importance further weighting; Under the light of the social contract, the principle of governance and the Bona Fide, a balance must necessarily exist, therefore, it is necessary to delimit the content of the same in order that its functionality is carried out within an ideal framework where the Law To the Resistance, do not violate other rights enshrined in our legal system.
