Tomando en cuenta la realidad cambiante y la creciente necesidad de esta para regirse por normas de derecho que se proyecten acorde a una realidad que propende dentro de su dinámica al manejo de estándares vanguardistas, surge la incógnita sobre si procede –o no, plantear una exhaustiva revisión de los cuerpos legales que se encargan del tratamiento de la contratación dentro del sistema bancario, y, específicamente en lo que concierne a la contratación electrónica, tema objeto de análisis en el presente trabajo de titulación, mismo que pretende ofrecer, en sus esfuerzos por interpretar y adaptar la norma a las necesidades de la sociedad actual, una interpretación de la norma en cuestión que permita, claramente un camino ágil que posibilite la aplicación de la mencionada modalidad de contratación, enfocándonos en el contenido que subyace al artículo 252 del Código Orgánico Monetario y Financiero, desde el momento en que se refiere al término suscripción, en adelante, tomando en cuenta, de manera fundamental, la realidad en la que se desenvuelven los documentos físicos, y la que corresponde a los documentos desmaterializados, en un entorno digital.
Taking into account the changing reality and the growing need for it to be governed by rules of law that are designed according to a reality that tends within its dynamics to the management of avant-garde standards, the question arises about whether or not to propose an exhaustive review of the legal bodies that deal with the treatment of contracting within the banking system, and, specifically with regard to electronic contracting, subject matter of analysis in the present work of titling, which seeks to offer, in its efforts to interpreting and adapting the standard to the needs of today's society, an interpretation of the rule in question that allows, clearly an agile path that enables the application of the aforementioned contracting modality, focusing on the content that underlies Article 252 of the Organic Code Monetary and Financial, from the moment it refers to the term subscription, in advance you, taking into account, in a fundamental way, the reality in which physical documents are developed, and the one corresponding to dematerialized documents, in a digital environment.
