La investigación realizada a continuación, se enfoca en determinar como el interés superior del niño, niña y adolescente repercute en sentencia del régimen de visitas, así como en los juicios de custodia en Ecuador. El análisis jurídico y legal de lo que dictamina la ley, tanto en la Constitución, como en el Código Orgánico de la Niñez y adolescencia serán clave para el análisis de la información y cumplir con los objetivos planteados en el trabajo. De igual forma durante este análisis se determinará si existe incumplimiento en el régimen de visitas, pues actualmente en el país, existen muchos casos donde por disputas ajenas al bienestar del infante, este es separado de alguna figura paterna solamente por pretender hacer daño a la persona, más, sin embargo, los daños reales son para el menor. Finalmente, luego de recopilar toda la información, se expresarán los resultados en forma de conclusiones que servirán para la mejora de la base legal y el cumplimiento del régimen de visitas.
The investigation carried out below focuses on determining how the best interests of the child and adolescent affects the sentence of the visitation regime, as well as custody trials in Ecuador. The juridical and legal analysis of what the law dictates, both in the Constitution and in the Organic Code for Children and Adolescents, will be key to analyzing the information and meeting the objectives set out in the work. In the same way, during this analysis, it will be determined if there is non-compliance in the visitation regime, since currently in the country, there are many cases where the child is separated from a father figure for revenge only for intending to harm the person, more, however, the actual damages are for the minor. Finally, after collecting all the information, the results will be expressed in the form of conclusions that will serve to improve the legal basis and compliance with the visitation regime.
