A través de los años la víctima del delito ha sido invisibilizada, por lo que el propósito principal de la persecución penal fue la de sancionar al infractor a través de la imposición de penas hasta la década de los ochenta en la que surge la victimología. La victimología es la ciencia que se encarga principalmente de analizar el papel de la víctima en el delito, si tuvo alguna responsabilidad en el acto delictivo y las razones que le llevaron a ser víctima. En la actualidad, la victimología ha trascendido a favor de la víctima, dándole mayor protagonismo por haber sido perjudicado en sus derechos dado que ahora se concentra especialmente en tener mayor relevancia en el proceso penal y tiene como propósito la debida reparación integral de la víctima. Existen normas nacionales e internacionales enfocadas en la víctima, pese a esto en Ecuador no se ha evidenciado un trato oportuno hacia la misma, convirtiéndose en una problemática en el sistema jurídico. El presente trabajo tiene como objetivo principal analizar a la victimología y como esta ha trascendido al pasar de los años enfocándolo en el Abuso Sexual Infantil en el Ecuador y su respectivo procedimiento penal para la imposición de la sanción correspondiente.
Over the years the victim of the crime has been made invisible, so the main purpose of the criminal prosecution was to punish the offender through the imposition of penalties until the eighties in which the victimology emerged. Victimology is the science that is mainly responsible for analyzing the role of the victim in the crime, if he had any responsibility in the criminal act and the reasons that led him to be a victim. At present, the victimology has transcended in favor of the victim, giving him greater prominence because his rights have been harmed, since now it is especially concentrated on having greater relevance in the criminal process and its purpose is the due comprehensive reparation of the victim. There are national and international standards focused on the victim, despite this in Ecuador there has not been evidence of a timely treatment of the victim, becoming a problem in the legal system. The main objective of this work is to analyze victimology and how it has transcended over the years, focusing on Child Sexual Abuse in Ecuador and its respective criminal procedure for the imposition of the corresponding sanction.
