El hacinamiento es una realidad que provoca eventos violentos en el sistema carcelario, ante la necesidad de tener un espacio adecuado para vivir. El presente trabajo de titulación tiene por objetivo analizar la aplicación del indulto en el sistema carcelario para disminuir los hacinamientos en centros penitenciarios a personas privadas de liberta de grupos vulnerables, personas privadas de libertad con sentencia condenatoria ejecutoriada y personas privadas de liberta que se encuentran con prisión preventiva que mantengan buena conducta después del delito. Se usará una metodología descriptiva con enfoque cualitativo, se valdrá del método científico, deducción y análisis de los datos obtenidos mediante revisión bibliográfica y entrevistas a profundidad aplicada a veinte abogadospertenecientes al foro registrado en el consejo de la judicatura de la provincia de Sucumbíos de la necesidad de la aplicación del indulto en el sistema carcelario para disminuir los hacinamientos en centros penitenciarios. El procedimiento de análisis de datos partirá de la revisión de la normativa jurídica vigente, elaboración del cuestionario de entrevistas a profundidad, validación y aplicación del instrumento para finalmente analizar y publicar los resultados, mismos en que se espera conocer el punto de vista de quienes ejercen el derecho sobre el indulto y los hacinamientos.
Overcrowding in prisions is a reality that causes violent events in the prison system, given the need to have an adequate space to live. The objective of this qualification work is to analyze the application of the pardon in the prison system to reduce overcrowding in prisons for people deprived of liberty of vulnerable groups and those who have an enforceable judgement with good behavior after their crime. A descriptive methodology with a qualitative approach will be used, it will use the scientific method, deduction and analysis of the data obtained through bibliographic review and in-depth interviews applied to lawyers belonging to the forum registered in the council of the judiciary of the province of Sucumbíos of the Necessity of the application of the pardon in the prison system to reduce the overcrowding in penitentiary centers. The data analysis procedure will start from the review of the current legal regulations, elaboration of the questionnaire of in-depth interviews, validation and application for to finally analyze and publish the results, in which it is expected to know the point of view of those who practice the right to pardonand overcrowding.
