La justicia ordinaria como mecanismo para evadir la tutela de un derecho en la acción de protección.

La presente investigación tuvo como objetivo general proponer una modificación a la Ley Orgánica de Garantías Jurisdiccionales y Control Constitucional, referida a la protección del derecho tutelar en la acción de protección y justicia ordinaria. Como objetivos específicos analizar la fundamentación teórica de la acción de protección y el derecho a la tutela efectiva, determinar los derechos vulnerados en los procedimientos de la justicia ordinaria como mecanismos para evitar el derecho a la tutela en la acción de protección y diseñar una propuesta para modificar el Art. 42 de la Ley Orgánica de Garantías Jurisdiccionales y Control Constitucional en el trascurso de ejecución del amparo de protección y la tutela efectiva. Dentro de sus resultados más destacados se pudo observar que muchos abogados en el libre ejercicio de la profesión, utilizan está acción con el fin de eludir la vía ordinaria y beneficiarse del procedimiento de la acción de protección. Se concluyó que la acción de protección es la vía más idónea que existe de acuerdo a la legislación vigente para evitar la violación de un derecho constitucional, y que sean inherentes a cada ciudadano. Por último, se recomendó a la Asamblea Nacional la modificación de la Ley Orgánica de Garantías jurisdiccionales y Control Constitucional erradicando el numeral 4 del artículo 42 de la Ley Orgánica de Garantías Jurisdiccionales y Control Constitucional, así como reformar el numeral 1 del artículo 41 eiusdem.
The present investigation had the general objective of proposing an amendment to the Organic Law of Jurisdictional Guarantees and Constitutional Control, referring to the protection of tutelary law in the protection action and ordinary justice. As specific objectives, analyze the theoretical foundation of the protection action and the right to effective protection, determine the violated rights in ordinary justice procedures as mechanisms to avoid the right to protection in the protection action and design a proposal for modify art. Art. 42 of the Organic Law of Jurisdictional Guarantees and Constitutional Control on the process of application of the protection action and effective protection. Among its most outstanding results, it was observed that many practicing lawyers use this action in order to avoid the ordinary route and benefit from the extraordinary protection action procedure. It was concluded that the protection action is the most su³itable way to go. It exists in accordance with current legislation to avoid the violation of a constitutional right, and that they are inherent to each citizen. Lastly, the National Assembly was recommended to amend the Organic Law of Jurisdictional Guarantees and Constitutional Control by deleting paragraph 4 of article 42 of the Organic Law of Jurisdictional Guarantees and Constitutional Control, as well as to reform paragraph 1 of article 41 eiusdem.
