El presente trabajo tiene por objeto el análisis del error inexcusable, que podría definirse como un tipo sancionado administrativamente. En nuestro país existen lagunas respecto al error inexcusable, sus características y sanción por cuanto solo se lo contempla de manera subjetiva y no se encuentra estipulado en la Ley; debiendo el organismo encargado de promulgar las leyes tipificarlo a fin de que no existan violaciones a la seguridad jurídica y al debido proceso de los sumariados por este acto. Pese a que en las resoluciones dictadas por Control Disciplinario que se han iniciado contra funcionarios públicos por este tema, aún existen dudas respecto al tema, debido a que, al no haber una definición taxativa del error inexcusable, al nombrarlo lo hacen de una manera muy peculiar, en razón a lo antes mencionado, se hará una explicación detallada doctrina nacional y así también internacional, además de informes emitidos por el consejo de la Judicatura.
In this work we are going to analyse the inexcusable mistake that could be defined as a type administratively sanctioned. In our country there are voids about inexcusable mistake, its characteristics and sanction. because it is only considered in a subjective manner and is not stipulated in the Law; the body in charge of promulgating the laws should typify it so that there are no violations of the legal security and due process of the accused by this act. Instead there are resolutions of Court about disciplinary that have been initiated against public officials on this issue, there are still doubts on the subject, because in the absence of a definite definition of the inexcusable error, by naming it they do it in a very peculiar way, because of the aforementioned, a detailed explanation of the national and international doctrine and resolutions issued by the council of the Judicature will be made.
