La presente investigación tiene como título el Fraude Procesal en el Derecho Penal, que tuvo como objetivos, analizar, determinar la eficacia y efectividad sobre el delito ya que este no guarda proporción con la pena que recibe en la actualidad, esta investigación se llevó a cabo utilizando el método inductivo, deductivo jurídico doctrinario, analítico sintético, exegético, que permitió el estudio y medición de variables, igualmente la aplicación de instrumentos de recolección de datos como la encuesta y la entrevista aplicada a abogados ya sea del libre ejercicio como servidores públicos de la provincia del Guayas, Ecuador así como también datos informativos de este delito que tiene a cabo la Fiscalía General del Estado. Sobre este proceso se concluyó que la pena que tiene el delito de fraude procesal no es proporcional al daño que ocasiona que esta debería ser reformada por una pena mayor a la que consta en la actualidad que es de uno a tres años y que deja desprotegida a muchas áreas del derecho en el Ecuador.
The title of this investigation is Procedural Fraud in Criminal Law, whose objectives were to analyze, determine the efficacy and effectiveness of the crime, since this is not in proportion to the penalty it currently receives, this investigation was carried out Using the inductive, deductive legal doctrinal, synthetic analytical, exegetical method, which allowed the study and measurement of variables, as well as the application of data collection instruments such as the survey and the interview applied to lawyers, whether in the free exercise as public servants of the province of Guayas, Ecuador as well as informative data on this crime carried out by the State Attorney General's Office. Regarding this process, it was concluded that the penalty for the crime of procedural fraud is not proportional to the damage that it causes that it should be reformed by a penalty greater than the one that currently consists of one to three years and that leaves unprotected many areas of law in Ecuador
