This work reflects a personal legal concerns, about whether there is any connection between the Succession Law in Intellectual Property, in consideration of the economic rights to the product of human intellect is considered an intangible asset, and being considered an intangible asset is or is not likely to be transmitted mortis causa. Within the economic rights, has made a study of the kind of goods their transmissibility by mortis causa, for this sequence has been analyzed by cause of death regulated by the Civil Code. It decrypts the intellectual property gives the author exclusive rights to their work, trademark, patent, industrial design and other types of invention. Demonstrated throughout this research work, the rights to use trademarks and patents are transmitted mortis causa to the heirs of the copyright owner, either as part of a probate or intestacy
Este trabajo obedece a una inquietud jurídica personal, respecto a si hay o no relación entre el Derecho Sucesorio con el Derecho de Propiedad Intelectual, en consideración de que para el Derecho Patrimonial, el producto del intelecto humano es considerado un bien inmaterial, y por ser considerado un bien inmaterial es o no susceptible de transmitirse por mortis causa. Dentro del Derecho Patrimonial, se ha hecho un estudio de la clase de bienes su transmisibilidad por mortis causa, para ello se ha analizado la sucesión por causa de muerte reglada por el Código Civil. Se descifra que la propiedad intelectual otorga a su autor derechos exclusivos sobre su obra, marca, patente, diseño industrial y otros tipos de invención. Demostrándose a lo largo de este trabajo investigativo, que los derechos de explotación de las marcas y patentes se transmiten por mortis causa a los sucesores del titular de estos derechos, ya sea en el marco de una sucesión testamentaria o abintestato.
