Política criminal preventiva: desarrollo de medidas de prevención a través de un perfil criminal preexistente

Ecuador is already several years mired in what has been called a revolution, and several other changes had been promoted. Thus, new ideological and academic trends have been appearing in political field, neoconstitutionalism is not a new trend at all, but a concept that recently and belatedly inserted in the Ecuadorian legal culture offers us the guarantee that the state is our protector and benefactor all of the times, and this is their primary duty. This article dispute and analyzes the concept of “good living” that is promoted every day to the citizens, taking in consideration that there are a number of overriding factors in the life of a human being and given their lack or deficiency, the consequences can be really serious, not only to the individual himself, but society altogether. What is proposed is to use the right way that gets most benefits for our kind of society, such as one existing tool: the criminal profile, which improves prevention concepts. Engaging a joint effort among the foremost authorities of the government, including the implementation of a software tool to narrow down what is known as criminal profiling, our country could assign new functions to lead a new era of justice focused on prevention.
El Ecuador se encuentra ya hace varios años sumido en lo que se ha denominado una revolución, varios y distintos cambios se han venido promoviendo. Así, nuevas tendencias ideológicas y académicas han venido tomando espacio; el neoconstitucionalismo, que no es una corriente nueva en lo absoluto, sino más bien un concepto que, recién y tardíamente se ha insertado en la cultura jurídica ecuatoriana; nos ofrece la garantía de que el Estado es nuestro protector y benefactor en todo momento, siendo este su primordial deber. Este trabajo cuestiona el concepto de buen vivir que día a día se vende a los ciudadanos, analizando que, existen un sin número de factores trascendentales en la vida de un ser humano y que, ante su carencia o deficiencia, las consecuencias pueden ser realmente graves, atañendo no solo al individuo mismo, sino a la sociedad por completo. Lo que se propone es utilizar de la manera adecuada y que más beneficie a una sociedad como la nuestra, una herramienta que ya existe, el perfil criminal, potencializando el concepto de prevención. Engranar un trabajo en conjunto entre los entes más destacados del aparato gubernamental, con el fin de que una vez implementada una herramienta informática que afine lo que conocemos como perfil criminal, se le pueda atribuir nuevas funciones que conlleven a una nueva era de la justicia que se enfoque en el ámbito preventivo.
