La suspensión del derecho a la inviolabilidad de domicilio en el estado de excepción decretado por la reactivación del Volcán Cotopaxi en el Ecuador

The state of emergency within the Constitutional State is a constitutional mechanism to prevent the safety and the integrity of the persons, as well as its rights faced with unpredictable events that generate internal crisis to the population. The revival of Cotopaxi volcano in Ecuador at August 2015, and the magnitude and risk that an eruption of this volcano involves, caused that the President of the Republic, in use of his attribution awarded by the Constitution and the Law, declares state of emergency in the whole national territory, that implies the suspension of constitutional rights as the inviolability of domicile. In this paper, there will be realize a doctrinaire and normative study of the state of emergency and the right of inviolability of domicile within the Constitutional State. Then, we will determine if the constitutional principles were observed, as well as if the formal and material requisites that the national legislation foresees for the declaration of state of emergency were accomplished by an exhaustive analysis of the Constitutional Report 017-15-DEE-CC that established the constitutionality of the Executive Decree 755-2015 that declared state of emergency.
El estado de excepción dentro del Estado Constitucional de Derecho se concibe como un mecanismo de garantía constitucional para precautelar la seguridad e integridad de las personas, así como sus derechos frente a acontecimientos impredecibles que generen conmoción interna en la población. La reactivación del volcán Cotopaxi en el Ecuador a mediados del mes de agosto del año 2015, por la magnitud y riesgo que una erupción de este volcán envuelve, ocasionó que el Presidente de la República declare estado de excepción en todo el territorio nacional, lo que implicó la suspensión de derechos constitucionales como la inviolabilidad de domicilio. En el presente ensayo se realizará un estudio doctrinario y normativo del estado de excepción y el derecho a la inviolabilidad de domicilio dentro del marco de Estado Constitucional de Derecho. Así mismo, se determinará si se observaron los principios constitucionales y si se cumplieron los requisitos formales y materiales que la legislación nacional prevé para la declaratoria de estado de excepción, mediante un análisis al Dictamen Constitucional 017-15-DEE-CC que establece la constitucionalidad del Decreto Ejecutivo 755-2015 que declaró estado de excepción.
