The 21st century came with great challenges for the international community, mainly because of the social demands that are as a result of the armed conflicto that continues in Syria. Conflict that left as its balance millions of displaced people, thousands of dead and a deep social problem of minors abandoned by the state system. For that reason, the international community analyzes and proposes possible solutions, to respond to the requirements of this priority group. However, resources are limited against needs. Consequently, the international community pretends to prioritize the group that is mostly vulnerable and have no legal or legislative support: Double orphan children. Who can be eligible to receive the state of refugee and subsequently, could be citizen who can be adopted. And by legalized the process, it would solve one of the mayor discussion about international law vs national law.
El siglo XXI llegó con grandes retos para la comunidad internacional, principalmente por las demandas sociales que se exigen. Actualmente, se continúa librando un conflicto armado en Siria, el cual tiene como saldo, millones de personas desplazadas, miles de fallecidos y una profunda problemática social de menores desamparados por el sistema estatal. Por lo que la comunidad internacional cuestiona y plantea posibles soluciones, para responder a los requerimientos de este grupo prioritario. Sin embargo, Los recursos son limitados frente a las necesidades. Por esta razón, se pretende priorizar al grupo mayoritariamente vulnerable y que no tienen amparo legal ni legislativo: Los menores de edad huérfanos dobles a causa de la guerra. Por medio de legitimación del proceso de adopción internacional, bajo el estado de refugio. Superando legalmente, la dicótoma entre el derecho internacional y el derecho doméstico.
