Análisis de doctrinas procesales: activismo judicial o garantismo procesal y su aplicación en la administración de justicia en el Ecuador

The new legal structure that established the Constitution of Montecristi in Ecuador has given way to an important recognition of rights to citizens. However, in the field of civil procedure now could occur a violation of the rights recognized in the Constitution, because of the contradiction between the rules that promote Judicial Activism and the Guaranties Litigation. According to the changing times in which there is a clear preponderance of human being, this paper tries to establish the possible transgressions that might involve the application of the doctrine of Judicial Activism and the Guarantee-Procedure, based on a historical valuation together with the analysis of the adequacy of the legal system of them, and finally taking a stand and raising the possible reforms that should be implemented to ensure effective recognition of the rights.
El nuevo marco legal que instauró la Constitución de Montecristi en Ecuador ha dado paso a un importante reconocimiento de derechos a los ciudadanos. Sin embargo, en el ámbito procesal civil en la actualidad podría ocurrir una vulneración de los derechos reconocidos constitucionalmente, debido a la contradicción existente entre las normas que promueven el Activismo Judicial y las que impulsan el Garantismo Procesal. Acorde a los tiempos de cambio en los cuales existe una clara preponderancia del ser humano, el presente trabajo intenta establecer las posibles transgresiones que podrían implicar la aplicación de la doctrina del Activismo Judicial y del Garantismo Procesal, partiendo de una valoración histórica complementada con el análisis de la adecuación del ordenamiento jurídico a las mismas, y finalmente adoptando una posición y planteando las posibles reformas que deberían implementarse para garantizar un efectivo reconocimiento de los derechos.
