La Acción de Nulidad Marcaria, Propuesta de Reforma Legislativa

The role of Intellectual Property lawyers not only to apply the normative efficiently, it is necessary to identify problems and propose practical solutions. So, although the figure of the trademarks nullity is regulated by the Andean Community rules, the fact remains that there are some problems of practical implementation by national authorities and users of the system, exist normative darkness. As such, considering the imminent reform of the Intellectual Property Law, it is appropriate to remedy existing problems through the reform of national legislation to regulate and clarify three fundamental aspects: Competition; filing terms and differentiation with the Revision Recourse and other actions. In fact, my objective is to propose reforms that contribute due process through effective implementation of procedural figure with which it seeks to restore legality, to rescind legal acts that should be nullity for non-compliance with legal requirements with governing the matter (legality matters not opportunity matters).
La función del abogado de Propiedad Intelectual, no solamente es aplicar la normativa que rige la materia de forma eficiente, es necesario identificar problemas prácticos y plantear soluciones. Así las cosas, si bien la figura de la nulidad marcaria está regulada por la normativa comunitaria andina, no es menos cierto que existen problemas de ejecución práctica por parte de las autoridades nacionales y usuarios del sistema, al existir obscuridad normativa. En tal virtud, considerando la inminente reforma de la Ley de Propiedad Intelectual, resulta oportuno solventar los vacíos jurídicos existentes mediante la expedición de normativa nacional que regule y clarifique tres aspectos fundamentales: Competencia; plazos de interposición y la diferenciación respecto del Recurso Extraordinario de Revisión y otras acciones. En definitiva, mi intención es proponer reformas que coadyuven el debido proceso, mediante la aplicación efectiva de una figura procedimental con la que se busca restablecer la legalidad, al dejar sin efecto actos jurídicos que debían ser nulos por el incumplimiento de los requisitos legales que rigen la materia (motivos de legalidad y no de oportunidad).
