In the last years, the law and the compared doctrine teach us a notable increment in the number of claims against lawyers for legal malpractice. All these claims look for establish the professional liability of the lawyers for the damages caused to their clients. In this investigation is carried out a systematic examination of the main problems that surround the topic, supported in a lot of sentences of the Spain´s Supreme Court. In this work stands out the study of the damage that the negligent lawyer can cause when doesn´t keep client's documents in organize and safe way, and how this is reflected in the damage denominated by the doctrine like "loss of a chance." The present work looks to settle down how our juridical classification contemplates the civil responsibility, and how this can be applied to the professional responsibility of the lawyers and under what kind of legal regime.
En los últimos años, el derecho y la doctrina comparada nos muestran un incremento en el número de demandas contra abogados por mala praxis. Todas estas buscando establecer la responsabilidad civil de los abogados por los daños ocasionados a sus clientes. En esta investigación se realiza un examen sistemático de los principales problemas que giran alrededor del tema, apoyados en las innumerables sentencias del Tribunal Supremo Español. Se destaca el estudio del daño que puede provocar el abogado negligente, por la no custodia de documentos del cliente, y como esta se refleja en el daño denominado por la doctrina como “perdida de chance”. La presente tesina busca establecer como nuestro ordenamiento jurídico contempla la responsabilidad civil, y como esta puede ser aplicada a la responsabilidad profesional de los abogados y bajo qué régimen legal.
