This dissertation is a study of the most controversial limitations to Advertising Law at the present time, such as generic packaging and its application to tobacco products. It analyzes the rights of freedom, property, and those of consumers; it also considers the origins of advertising, its current significance, and regulation. Furthermore, it studies the new regulatory trends and the various constraints that exist regarding Advertising Law, concluding with the analysis of generic packaging of tobacco products. The dissertation is a wide-ranging study of the fundamental rights possibly committed in the execution of generic packaging in the light of the analysis of the legality of this measure as an effective method to reduce the smoking population.
La presente tesina es un estudio de las limitaciones al Derecho Publicitario que generan la mayor controversia en la época actual, como lo es el empaquetado genérico y especialmente su aplicación a los productos del tabaco. Este trabajo parte de la base analítica de los derechos de libertad, propiedad y los derechos de los consumidores; considerando los orígenes de la publicidad, su trascendencia actual y su regulación. Asimismo, estudia las nuevas tendencias regulatorias y las diversas limitaciones que existen respecto del derecho publicitario; concluyendo con el análisis del empaquetado genérico. Esta tesina realiza un estudio exhaustivo de los derechos fundamentales que podrían considerarse comprometidos en la aplicación del empaquetado genérico a la luz del análisis de la legalidad de esta medida como método efectivo para disminuir la población fumadora.
