Publicidad y registrabilidad de los negocios fiduciarios en el Ecuador

Description: This work is aimed to show how the omission of registration of fiduciary rights and tittles generates legal uncertainty to third parties who would become affected by the conformation of a trust. Comparative law in the matter teaches us that the lack of registral publicity becomes an important legal problem in the practice of trusts. Therefore this thesis propones and recommends the adoption in the future of registral publicity mechanisms that guaranty legal certainty to third parties.
El presente trabajo plantea demostrar como la ausencia de un registro de títulos de dominio fiduciario podría generar inseguridad jurídica para terceros que eventualmente resulten afectados por la constitución de un fideicomiso mercantil. La legislación comparada en la materia ha demostrado que la ausencia de publicidad registral constituye un problema jurídico importante en la práctica del expediente fiduciario. Es así como en este estudio se recomienda la adopción a futuro de mecanismos de publicidad registral que permitan dotar de seguridad jurídica a terceros.
