The purpose of this paper is to analyze the possibility that plant breeders are also entitled for essentially derived varieties that have been obtained by methods in which no human intervention was done. Therefore, the analysis consists on determining if plant breeding is applied in those cases. In regard to what was indicated, we have to make the following question: Is possible to protect essentially derived varieties in which there has been no human intervention? Although Ecuadorian law does not deeply address the essentially derivate varieties concepts, this requires a deep analysis of its applicability and performance. Furthermore, it is important to mention that plant breeding is the mainstay of the protection of plant varieties.
La finalidad del presente trabajo es determinar si los obtentores vegetales pueden ser titulares de variedades esencialmente derivadas que se han obtenido mediante métodos en los que no existe intervención humana. Por consiguiente, el análisis consiste en establecer si la puesta a punto o mejora vegetal que prevén las normas se da en esos casos. Tomando en cuenta lo señalado, cabe hacer la siguiente pregunta: ¿Se puede proteger variedades esencialmente derivadas en las que no ha existido intervención del ser humano? A pesar de que la legislación ecuatoriana no trata el tema a profundidad, solamente establece el concepto de variedades esencialmente derivadas no existe un profundo análisis sobre su aplicabilidad o funcionamiento. Adicionalmente, es importante mencionar que el fitomejoramiento, o puesta a punto son el pilar fundamental de la protección de variedades vegetales.
