La presente Investigación Académica tiene como objetivo el análisis de la problemática existente referente sobre en qué momento procede la Prescripción de la Potestad Sancionadora y por otra parte la Caducidad de un Procedimiento Sancionador en los Gobiernos Autónomos Descentralizados en cuanto a las infracciones cometidas por los administrados dentro de un Proceso Administrativo, para lo cual se necesita analizar cada Institución Jurídica como es el de la Prescripción y Caducidad; y por otra parte estudiar el Código Orgánico Administrativo ya que es la norma que rige a la Administración Pública en general con la finalidad de que el administrado tenga seguridad jurídica al momento de poder defenderse sobre posibles acciones que tome el GAD Municipal al momento de querer imponer una sanción cuando esta ya no sea procedente debido a su tiempo transcurrido.
The purpose of this research paper is to analyze the existing problems regarding the moment in which the prescription of the Sanctioning Power arises and the Expiration of a Sanctioning Procedure in the Decentralized Autonomous Governments in terms of the infractions committed by those administered within an administrative process as well, for which it is important to analyze each legal institution such as prescription and expiration. On the other hand, it’s also important to study the administrative organic code since it is the norm that governs the Public Administration in general and whose purpose is that the administered has legal certainty at the moment of being able to defend himself on possible actions taken by the municipal GAD at the moment of wanting to impose a sanction when it is no longer adequate due to its elapsed time.
